Terms of Service (TOS)

By using our ATC service the Buyer (collectively, "you" and/or "your") is hiring ElevatedGeneration.com (collectively, "our", "us" and/or "we") as an independent contractor on your behalf to add a shoe for you in your shopping cart and complete the checkout process on any authorized Nike and Adidas shoe retail ecommerce site ("Authorized Retailer").

You are contracting us to add a sneaker to your online shopping cart and complete the checkout process with an Authorized Retailer ("Services") for you by using the log in information you provide and the money that you pay us to purchase the shoe online ("Advance Payment"), on your behalf in good faith of payment for Services rendered.

After our Services are completed the contract shall be terminated. You agree that ElevatedGeneration.com will no longer be responsible for anything that happens after we complete the checkout process for your shoe. You agree that we are not liable for any damages, including but not limited to, physical damages to the product and/or its packaging, shipment of wrong products, wrong size of product or any errors of any Authorized Retailer. After the contract has been terminated you agree that no refund will be given due to Services having already been rendered and further release us from any liability.

We advertise guaranteed ATC orders but have no control over the outcome of the service due to but not limited to Nike and Adidas intervention, site changes, program errors, coding errors, human error, 3rd party interference, etc. We guarantee that we will do our job and checkout the shoe on your behalf. If we obtain an official order confirmation from the Authorized Retailer, which means the shoes were successfully purchased, we hold the right to refuse a refund. If we are unable to successfully checkout the shoe, you are entitled to a full refund of the Advance Payment (minus any additional Restock Fee, as defined below).

If a Nike and/or Adidas shoe is sold out, there will be an opportunity to purchase the shoe once Nike and/or Adidas restock it. For an additional service fee ("Restock Fee"), you are entitled to purchase the restocked shoe as a priority buyer ("Priority Restock Buyer") as soon as Nike and/or Adidas restock the shoe. As a Priority Restock Buyer, you agree to us holding your Advance Payment, in addition to the Restock Fee, in an escrow account until the shoe is restocked and available for ATC service.

You agree to hold harmless and indemnify ElevatedGeneration.com, it subsidiaries and its affiliates, and their respective directors, officers, agents, employees, consultants, agents and partners, from and against any third party claim arising from or in any way related to this terms of service, including any liability or expense arising from claims, losses, damages (actual or consequential), suits, judgments, litigation costs and reasonable attorneys' fees, of every kind and nature.

ElevatedGeneration.com reserves the right to change or modify any of the terms and conditions of this TOS from time to time in its sole discretion. ElevatedGeneration.com may make such changes or modifications to the terms and conditions contained in this TOS in accordance with the terms of this TOS and Buyer's continued use of the Services following ElevatedGeneration.com's posting of any changes or modifications will constitute Buyer's acceptance of such changes or modifications.
